This prize draw is open, subject to any other qualifications in these terms and conditions, to all residents of the United Kingdom who are aged 21 years or over with a valid email address, except for employees of the Promoter, its associated companies, agents, third parties or anyone else professionally connected with this prize draw. Proof of age may be required.

By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions. The instructions provided at the point of entry form part of the terms and conditions of this prize draw. In the event of a conflict, these terms and conditions take precedence. 

To enter the prize draw you must have an active MyWaitrose membership.

1.4 No purchase necessary. There is no charge to submit an entry via the website at waitrose.com/ILOVENY 

DEADLINE FOR ENTRIES

2.1 Entries must be received between 00:01 on 9 October 2024 and 23:59 on 5 November 2024 (the “Closing Date”). Entries received after the Closing Date will not be accepted. 

HOW TO ENTER

To enter, simply go to waitrose.com/ILOVENY, follow the prize draw instructions at the top of the page and submit your details and other required information using the online form provided. 

There is a limit of one entry per person. Multiple entries submitted directly or with the use of any automated systems will not be entered into the draw.

No responsibility will be accepted for entries that are lost, delayed, mislaid or damaged in transit, regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind. 

Those entries not in accordance with the rules will be void and will entitle the Promoter to exclude the entry from the prize draw; any entry containing false, incomplete or misleading information will be void and will entitle the Promoter to exclude the entry from the prize draw. 

THE PRIZE

The prize is an 11 night holiday for two people to New York State including return flights from London, 11 nights’ accommodation and 9 days car hire. There is one prize available to be won. 

The prize of a ‘12 Day Discover the Taste of New York State’ holiday, which will be provided by Travelbag, is for two people and includes two return economy class tickets (from London to New York City, returning from Buffalo airport to London), 9 days car rental in an Intermediate car (Inclusive of Loss Damage Waiver, Unlimited Mileage, Liability Protection, Provincial and Local Taxes) and 11 nights’ accommodation in one standard room throughout, minimum 3* hotel, on room only basis. 

A transfer from New York City airport to the New York City hotel is not included and will need to be arranged and paid for by the winner. Car hire will be provided from day 4 of the itinerary in New York City and will need to be returned at Buffalo Airport on the last day of the itinerary.

Drivers must be over 21 years to drive in the USA and present a valid UK driver’s licence together with a ‘named driver’ credit card to cover any extra charges. Please note that if the winner is aged between 21 and 25, they will be required to pay a young drivers fee directly to the car provider.  No alternative transport options will be provided so the winner must be able to drive to claim this prize.

Upon check in at each hotel, the winner will be required to provide a credit card to cover any incidentals.

The winner and travelling companion must be eligible to travel and it is their responsibility to arrange and pay for a passport, ESTA or VISA and adequate travel insurance before travelling to the USA. Please check with your local embassy for more information. The Tour Operator accepts no responsibility for the winner’s entry requirements or travel insurance.

Personal expenses, travel insurance, ESTA/VISA fees, passports, spending money, optional car rental charges, fuel, meals, drinks, tours and excursions, airport transfers, car parking, and any other incidentals that are not listed as included in the prize are the winner's responsibility. Any optional extras and upgrades available at time of booking will need to be paid for by the winner.

Any additional taxes, costs and expenses incurred during the trip will be the responsibility of the prize winner.

The prize is subject to availability and black out dates may apply. The holiday must be taken and completed no later than 30th September 2025. Seasonal blackout periods apply and include; 1 December 2024 – 5 January 2025, 15 – 23rd February 2025, 12 April 2025 – 27 April 2025, 24th May – 1st June 2025, and 1st – 6th July 2025. All accommodation and flights are subject to availability and additional black out dates may apply.

Prizes are subject to availability. They are non-transferable, non-refundable and, unless stated, there are no cash alternatives. In the event that the prize is unavailable or if circumstances beyond the Promoter’s control make it necessary to do so, the Promoter reserves the right to substitute with an alternative, in its sole discretion, of equal or higher value. 

In the event of cancellation by the winner, for whatever reason, no alternative prize will be given. 

The Promoter will not be held liable for a prize if it does not reach the winner for reasons beyond its reasonable control

WINNER SELECTION

All valid and, if applicable, correct entries received by the Closing Date will be entered into a prize draw, and the winners will be picked at random.  

The winner’s details (surname and county only) will be available for one month after the Closing Date by sending a request to the Promoter by at Waitrose Limited, Media Team, Floor 2, Waite House, Doncastle Road, Southern Industrial Area, Bracknell RG12 8YA, enclosing a stamped self-addressed envelope, or alternatively by emailing customerserviceteam@waitrose.co.uk.

WINNER NOTIFICATION

Winners will be notified by email, text or phone call within 14 days after the prize draw, using the contact details provided with the prize draw entry. The winners will be required to respond within 30 days of notification (unless otherwise stated) confirming their acceptance of the prize. In the event winners do not respond to communications within this period or if any prize is declined, the Promoter reserves the right to disqualify that winner and draw another winner. 

Once the winner has accepted the prize, a Travelbag representative will contact the winner to finalise the booking details. The prize must be booked within 30 days.

7.2 Entrants into the competition who opt-in to receive marketing information via electronic means (email or SMS), telephone or post consent to Travelbag using their personal data in accordance with the Privacy Policies, and to share offers via email and advertising. Entrants can withdraw their consent at any time.

LIMITATION OF LIABILITY

The Promoter and its associated agencies, companies and distributors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this prize draw or accepting or using the prize, except for any liability which cannot be excluded by law (including liability for fraud or death or personal injury arising from negligence) in which case that liability is limited to the minimum allowable by law. Your statutory rights are not affected.

If you have opted-in to receive further information or marketing from any of the Promoter’s agents or suppliers involved in the administration of this prize draw, you understand and accept that the relevant third party will be solely responsible for any processing of your personal data for these purposes, that such processing will be governed by terms of that third party’s privacy policy and that the Promoter accepts no responsibility or liability in association with any such data processing for these purposes.  

GENERAL

If there is any reason to believe that there has been a breach of these terms and conditions or if the Promoter believes that your conduct may be unlawful or otherwise bring the prize draw into disrepute, the Promoter may, at its sole discretion, reserve the right to make your entry void and will entitle the Promoter to exclude you from participating in the prize draw.

The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into.

The Promoter reserves the right to suspend, cancel, or amend the prize draw where it becomes necessary to do so, with no liability to any entrants or third parties.

This prize draw and all issues arising out of it shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the English courts.
