Prize Draw Terms and Conditions

The Promoter is set out at the end of these Terms and Conditions.

WHO CAN ENTER

This prize draw is open, subject to any other qualifications in these terms and conditions, to all residents of England and Wales who are aged 21 years or over with a valid email address, except for employees of the Promoter, its associated companies, agents, third parties or anyone else professionally connected with this prize draw. Proof of age may be required.

By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions. The instructions provided at the point of entry form part of the terms and conditions of this prize draw. In the event of a conflict between these terms and conditions and those in any promotional material, these terms and conditions take precedence. 

Purchase of any Stella Artois or Leffe Blonde product from the list below, subject to availability online and/or in store, from Waitrose is necessary. You will need your receipt number to enter. There is no charge to submit an entry via the website at waitrose.com/winatriptonewyork24.

DEADLINE FOR ENTRIES

Purchase and enter between 00:01 04 December 2024 and 23:59 on 1 January 2025 (the “Promotion Period”). Entries received after the end of the Promotion Period will not be accepted.

HOW TO ENTER

To enter, simply go to waitrose.com/winatriptonewyork24, follow the prize draw instructions at the top of the page and submit your details and other required information using the online form provided

There is a limit of one entry per person. Multiple entries submitted directly or with the use of any automated systems will not be entered into the draw.

No responsibility will be accepted for entries that are lost, delayed, mislaid or damaged in transit, regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to waitrose.com/winatriptonewyork24.

Those entries not in accordance with the rules will be void and will entitle the Promoter to exclude the entry from the prize draw; any entry containing false, incomplete or misleading information will be void and will entitle the Promoter to exclude the entry from the prize draw. 

THE PRIZE

There will be 1 winner. The winner will win a 4 night trip to New York City, USA, for the winner and a guest including: return flights, 4 nights’ accommodation at The Aura Hotel, £1400 spending money, £200 travel money and a £500 Macy’s gift card. 

Further prize details and conditions: 

The guest must be aged 21 or over. 

The Prize will be arranged by email between the Promoter and the winner. The Promoter will make all reasonable efforts to provide the winner with details of the prize at the earliest possible opportunity. The Promoter will have final discretion on all elements and aspects of how the Prize is organised. Once the Prize details including dates, locations are confirmed, this cannot be amended or altered by the winner.

The holiday must be booked and taken by 30 April 2025 (subject to availability).  At least 4 weeks’ advance notice of preferred date of stay must be given. The prize cannot be taken during the excluded dates listed below. Stays may not be booked on the following dates: Valentine’s Day, Easter, school holidays or Bank Holiday periods in the UK or USA.

The prize includes return economy flights for the winner and a guest from London Heathrow Airport to John F. Kennedy International Airport, subject to availability and the Promoter’s discretion. 

Once booked, tickets are only valid for the dates and times shown; no alternatives will be available.

If a booking is cancelled by the winner, no alternative tickets will be issued and for the avoidance of doubt, no compensation and/or refund will be provided.

The winner will not be entitled to any compensation and will have no claim against the organisers if the holiday or any other event forming part of the Prize is delayed, postponed, rescheduled or cancelled.

Lounge passes and upgrades are not permitted. Flights cannot be used in conjunction with the Promoter's/any loyalty programme, any other discount, discount coupon(s) or voucher(s), promotion(s) or special offer. Frequent Flyer points cannot be accrued on the flight tickets or any loyalty programme.

Airline seats are subject to availability.

The winner and their guests must abide by and are subject to the airline’s Conditions of Carriage and Booking Terms and Conditions.

The winner and their guest must travel together in all instances, on the same dates and time, take the same trip and share the same room in all provided accommodation. The winner will forgo the prize in totality if the winner fails to attend the scheduled booking, and the Promoter and any prize providers shall have no further obligation to the winner. 

The winner and their guest will require a passport valid for at least 6 months on date of travel; any necessary visas or travel insurance are the responsibility of the winner and their guest. In the event the winner or their guest are unable to travel due to visa or other personal circumstances, no alternative tickets will be issued, and no compensation or other prize will be provided.

All elements of the prize package must be taken as part of the same trip.

The prize will be forfeited if:

The winner has not obtained all of the proper travel documents by the date specified by the Promoter; 

The winner has any immigration complications which prevent them from entering, leaving or travelling within the pre-booked period; or

The winner has any medical, legal or any other reason that would prevent you from accepting and participating in the prize.

The prize includes 4 nights’ accommodation in the deluxe double room at The Aura Hotel, in New York City, subject to availability. 

Winners can request extra services available at the hotel but at the winner’s own expense.

A valid credit or debit card will be required to check in to your room and will be used to guarantee any incidentals such as in- room calls or services.

The winner is solely responsible for any additional charges incurred at the hotel during their stay, including, without limitation, costs of meals, drinks, additional nights and services together with related taxes.

The winner is responsible for the behaviour of themselves and their guest whilst taking the prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or their guest from participation in any aspect of the prize if any party fails to comply with the directions of the Promoter or any companies associated with the prize or if the winner and/or their guest acts in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in the Prize being retracted. 

For the avoidance of doubt, the Prize does not include souvenirs, gratuities, car parking charges, or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the prize will be responsible for any such costs. Any travel expenses, or any other expenses in the general use of and enjoyment of the prize, that the winners or their guests incur are the sole responsibility of the winners or their guests.

The prize includes £200 travel money to be spent on their chosen method of transport from the airport in New York City to their hotel and back. 

The winner will receive the £200 travel money and £1400 spending money via BACS. 

The winner must have a valid UK bank account. 

Winners are responsible for providing correct bank account details and the Promoter will not be liable for any Prize payments made into the wrong bank account.

The winner will receive their £500 Macy’s gift card via post.. The address will be verified during winner communications.  

It is the responsibility of the participant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of the prize in order for their prize to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

The Promoter is not liable for any prizes once distributed/dispatched to a winner and the Promoter will not be responsible for any prizes not received, broken or lost in transit.

The Macy’s gift card must be redeemed in-store. 

The gift card will not have an expiry date.

All elements of the prize are subject to availability. The prize is non-transferable, non-refundable and cannot be redeemed for monetary value or for any other form of compensation. In the event that the prize, or any element of the prize, is not available, the Promoter reserves the right to substitute that prize or element of the prize for another item, in its sole discretion, of equal or higher value. 

The Promoter may request that the winner participates in publicity arising from the prize draw. Participation is at the winner’s discretion and is not a condition of prize acceptance.

WINNER SELECTION

All valid and, if applicable, correct entries received by the Closing Date will be entered into a prize draw, and the winners will be picked at random.  

The winner’s details (surname and county only) will be available for one month after the Closing Date by sending a request to the Promoter by at Waitrose Limited, Media Team, Floor 2, Waite House, Doncastle Road, Southern Industrial Area, Bracknell RG12 8YA, enclosing a stamped self-addressed envelope, or alternatively by emailing customerserviceteam@waitrose.co.uk.

WINNER NOTIFICATION

Winners will be notified by email, text or phone call as soon as practicable after the prize draw, using the contact details provided with the prize draw entry. The winners will be required to respond within 30 days of notification (unless otherwise stated) confirming their acceptance of the prize. In the event winners do not respond to communications within this period or if any prize is declined, the Promoter reserves the right to disqualify that winner and draw another winner. 

Please allow 30 days from the date of the winner’s address verification for delivery of the prize.

We will treat all of your personal data as confidential. We will keep it on a secure server and fully comply with all applicable privacy regulations and consumer legislation. LIMITATION OF LIABILITY

The Promoter and its associated agencies, companies and distributors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this prize draw or accepting or using the prize, except for any liability which cannot be excluded by law (including liability for fraud or death or personal injury arising from negligence) in which case that liability is limited to the minimum allowable by law. Your statutory rights are not affected. Nothing will exclude the Promoter’s liability for death or personal injury as a result of its negligence. 

If you have opted-in to receive further information or marketing from any of the Promoter’s agents or suppliers involved in the administration of this prize draw, you understand and accept that the relevant third party will be solely responsible for any processing of your personal data for these purposes, that such processing will be governed by terms of that third party’s privacy policy and that the Promoter accepts no responsibility or liability in association with any such data processing for these purposes.  

GENERAL

If there is any reason to believe that there has been a breach of these terms and conditions or if the Promoter believes that your conduct may be unlawful or otherwise bring the prize draw into disrepute, the Promoter may, at its sole discretion, reserve the right to make your entry void and will entitle the Promoter to exclude you from participating in the prize draw.

The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into.

The Promoter reserves the right to suspend, cancel, or amend the prize draw where it becomes necessary to do so, with no liability to any entrants or third parties.

This prize draw and all issues arising out of it shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the English courts.
